Terms of service

These Terms of Service govern use of oletoptical.shop and purchases made through our online store.

Throughout these Terms, references to “we”, “us” and “our” refer to oletoptical.shop where appropriate.

By accessing the website or purchasing through the store, users agree to comply with these Terms to the extent permitted by applicable law.

Nothing in these Terms limits or excludes mandatory statutory rights available to consumers.

Online Store

oletoptical.shop provides an online retail service allowing customers to browse products and purchase available products through an electronic checkout.

Our ecommerce infrastructure may be provided using Shopify and supporting third-party services.

Eligibility

Customers must have legal capacity to enter into the relevant transaction.

Where a customer is under the age at which they can independently enter into a binding purchase, an appropriate parent or guardian should be involved.

Customers must provide accurate information necessary to complete an order.

Product Information

We take reasonable steps to provide useful information concerning products.

However, minor errors, typographical mistakes or non-material differences may occasionally occur.

Colours may display differently depending on screens, photography and device settings.

Product availability is not guaranteed until an order has been accepted.

Eyewear and Optical Information

Any general information relating to eyewear or optical products on oletoptical.shop is provided for ecommerce and product-information purposes.

Unless expressly stated otherwise, website content does not constitute medical, ophthalmological or optometric diagnosis or treatment advice.

Customers requiring professional eye-care advice should consult an appropriately qualified professional.

Pricing

Prices are displayed through the store and checkout.

The customer will be shown the applicable price before submitting an order.

Where an obvious pricing or technical error occurs, we may decline or cancel an affected order where permitted by applicable law.

If payment has already been collected for an order that we lawfully cancel, the appropriate refund will be processed.

Orders

Submitting an order constitutes an offer to purchase the selected products.

We may decline or cancel an order where reasonably justified, including where:

  • The item is unavailable;
  • Payment cannot be authorised;
  • Information supplied is materially incorrect;
  • An obvious pricing or technical error has occurred;
  • Fraud or misuse is reasonably suspected;
  • Shipping cannot reasonably be completed; or
  • The transaction would violate applicable law.

Payment

Customers must provide valid payment information and be authorised to use the payment method selected.

Payments may be handled through third-party payment processors.

We are not responsible for delays caused exclusively by a customer's bank or payment provider, although this does not affect obligations that legally remain our responsibility.

Shipping

All orders are eligible for free standard shipping under our current shipping terms.

Our estimated delivery period is 15–20 calendar days.

More detailed provisions appear in our Shipping Policy.

UK distance-selling rules generally require delivery within 30 days unless another delivery period has been agreed.

Risk and Delivery

Responsibility for goods will transfer in accordance with applicable consumer law.

A parcel should not automatically be treated as successfully delivered merely because a carrier records an event where the circumstances demonstrate that lawful delivery to the customer has not actually occurred.

Customers should contact info@oletoptical.shop concerning material delivery problems.

Cancellation, Returns and Refunds

Qualifying consumers have statutory cancellation and return rights for online purchases.

Most qualifying online goods purchases allow the customer to notify cancellation within 14 days after receiving the goods and normally provide another 14 days to return the goods.

Our full procedures appear in the Return and Refund Policy.

Faulty Products

Nothing in these Terms excludes remedies relating to goods that are faulty, not of satisfactory quality, not fit for an applicable purpose or not as described.

Rights under the Consumer Rights Act 2015 and other applicable legislation remain unaffected.

Customer Accounts

Where customer account functionality is available, users are responsible for maintaining the confidentiality of their login credentials.

Users should notify us if they reasonably suspect unauthorised access to an account.

We may suspend account access where reasonably necessary to protect customers, the store or third parties against fraud, security threats or abuse.

Acceptable Use

Users must not use the website:

  • For unlawful purposes;
  • To commit fraud;
  • To impersonate another person;
  • To submit malicious code;
  • To interfere with website security;
  • To attempt unauthorised access to systems;
  • To scrape or harvest information in violation of applicable law;
  • To infringe intellectual-property rights;
  • To harass or harm another person; or
  • To interfere materially with the operation of the store.

Intellectual Property

Website content may include text, graphics, logos, photographs, layouts, product information, software and other materials protected by intellectual-property rights.

Except where permitted by law or expressly authorised, users may not reproduce, commercially exploit, distribute or create unauthorised derivative works from protected website materials.

Third-party trademarks and content remain the property of their respective owners.

Customer Content

If a customer submits a review, feedback or other content to us, the customer must have the right to provide that content.

Customers must not knowingly submit unlawful, defamatory, infringing, deceptive, malicious or abusive content.

Where legally permitted, we may moderate or remove inappropriate content.

Third-Party Services

Certain website functions may depend on third-party providers.

Third-party services may be governed by their own terms and privacy policies.

We are not responsible for independent third-party acts beyond the extent for which applicable law makes us responsible.

Website Availability

We aim to maintain reliable website access, but uninterrupted operation cannot be guaranteed.

Access may occasionally be interrupted for:

  • Maintenance;
  • Security updates;
  • Technical problems;
  • Hosting failures;
  • Network disruptions; or
  • Events beyond reasonable control.

Accuracy of Website Information

We may correct errors, inaccuracies or omissions appearing on the website.

We may also update product descriptions, availability or other information where appropriate.

Changes will not be used to deprive a customer of rights that have already arisen under an accepted contract.

Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing is intended to exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Nothing in these Terms excludes mandatory consumer remedies.

To the extent permitted by law, we are not liable for purely indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.

Events Outside Reasonable Control

We may not be responsible for delay caused by events genuinely outside our reasonable control, such as serious carrier disruption, natural disasters, severe weather, widespread network failures, government restrictions or major transport disruption.

Where such events materially affect an order, we will seek to handle the situation fairly and in accordance with applicable consumer law.

Privacy

Use of personal information is governed by our Privacy Policy.

Changes to These Terms

We may amend these Terms for future use of the website where reasonably necessary.

Terms applicable to an existing transaction will not be retrospectively changed in a manner that unlawfully deprives a customer of accrued rights.

Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to operate to the extent legally possible.

No Waiver

Failure to enforce a provision immediately does not necessarily amount to a permanent waiver of that provision or any legal right.

Governing Law and Consumer Rights

These Terms are governed by applicable laws of the United Kingdom and the laws applicable to the relevant transaction.

Nothing in these Terms is intended to deprive a UK consumer of mandatory protections or rights to bring proceedings in a court or jurisdiction that applicable consumer law makes available to them.
